NOTICE TO DEFENDANTS: “You have been sued. You may employ an attorney. If you or your attorney do not file a written answer with the clerk who issued this citation by 10:00 am on the Monday next following the expiration of 42 days after the date this citation was issued, a default judgment may be taken against you.”
You are hereby commanded to appear by filing a written answer to the Plaintiff’s Petition at or before 10:00 o’clock A.M. on the Monday next after the expiration of 42 days after the date of issuance of this citation the same being Monday August 01, 2017 before the Honorable MICHAEL MOORE, 29th Judicial District Court of Palo Pinto County, at the Courthouse in said County in Palo Pinto, Texas. Said Plaintiff’s Petition was filed in said court on the 23rd day of February, 2017 in the above entitled cause. A brief statement of the nature of this suit is as follows, to-wit:
You are hereby notified that suit has been brought by Wells Fargo Financial Texas, Inc., it’s successors and assigns, as plaintiff against M. Maxine Shupp aka Myrtle M. Shupp, and the Unknown Heirs at Law of David E. Shupp, Deceased, and any other person claiming any right, title, interest or possession in and to the property commonly known as 112 Riverside Drive, Mineral Wells, Texas 76067, and legally described as:
BEING LOT 12, RIVERSIDE ACRES SUBDIVISION, A SUBDIVISION IN PALO PINTO COUNTY, TEXAS ACCORDING TO THE PLAT RECORDED IN VOLUME 3, PAGE 10, OF THE PLAT RECORDS OF PALO PINTO COUNTY, TEXAS.
Plaintiff’s petition is styled Wells Fargo Financial Texas, Inc. v. M. Maxine Shupp aka Myrtle M. Shupp, and the Unknown Heirs at Law of David E. Shupp, Deceased. The Plaintiff seeks to enforce its home equity lien against and assert superior title to the above-described property. As is more fully shown by Plaintiff’s Petition on file in this suit.
